  • § 1 Scope of application

    The following terms of use apply to the use of this website and its functions in the relationship between the user (hereinafter referred to as "user") and the operator of the site (hereinafter referred to as "provider").

  • § 2 Registration, user account, conclusion of contract

    1. Prerequisite for the use of the functions provided by the provider is the registration via the corresponding online form.
    2. In principle, there is no legal claim to activation or participation in functions from the provider. The unrestricted house right of the operator applies.
    3. The user may not allow third parties to use his access. As the owner of the account, you are also responsible for protecting it against misuse. Your access data must therefore be protected against access by third parties.
    4. The use of words and Internet addresses protected by trademark law as user names is not permitted.
    5. The provider reserves the right to extend or remove the content and structure of the functions provided by him.
  • § 3 Services of the provider and limitation of liability

    1. The provider permits the user to publish content on his website within the framework of these terms of use. The provider provides the user with various functions free of charge within the scope of his technical and economic possibilities.
    2. The provider assumes no liability for the accuracy, completeness, reliability, timeliness and usefulness of the content provided.
    3. Unlimited liability: The operator is liable without limitation for intent and gross negligence and in accordance with the Product Liability Act. For slight negligence, the operator is liable for damages resulting from injury to life, limb and health of persons.
    4. The provider is liable for intent and gross negligence as well as for breach of a material contractual obligation. Essential contractual obligations are those whose fulfilment makes the proper execution of the contract possible in the first place and on whose observance the contractual partner may regularly rely. The provider shall be liable, limited to compensation for damages foreseeable at the time of conclusion of the contract and typical for the contract, for such damages which are based on a slightly negligent breach of essential contractual obligations by him or one of his legal representatives or vicarious agents. The provider is not liable for slightly negligent breach of secondary obligations which are not essential contractual obligations. The liability for damages that fall within the scope of protection of a guarantee or assurance given by the provider as well as the liability for claims based on the Product Liability Act and damages from injury to life, body or health remains unaffected by this.
  • § 4 Use of the profile

    The user has the possibility to use different services by means of his profile:
    1. The user has the opportunity to provide his own content (files, text, images, etc.) within the functions of the provider.
    2. The operator reserves the right to change or delete content provided by the user.
     
  • § 5 User obligations

    1. The user undertakes to observe the applicable law (e.g. criminal law, competition law and protection of minors) when publishing his own content and not to infringe the rights of third parties (e.g. trademark, copyright and data protection rights). In particular, the user undertakes not to publish any contributions,
      • the publication of which constitutes a criminal offence or a misdemeanour
      • that include offensive, racist, discriminatory, defamatory or pornographic
      • include appeals for and incitement to criminal offences and violations of the law, threats against life, limb or property
      • Glorification of violence and extremism of any kind include
      • Hunt against persons, companies, associations or others include
      • Offensive, sexist, vulgar, inhuman include
    2. The provider reserves the right to admonish, delete or temporarily or permanently block contributions, contents and the profile.
    3. The user commits himself when publishing his own content to protect it, if necessary (e.g. through Steam the provided Steam ownership check or adapted setup file).
  • § 6 Transfer of use rights

    1. The copyright for the contributions remains with the respective user. However, the user grants the provider the right, by posting content, to keep the contribution permanently available on his website and to make it publicly accessible. The provider has the right to move content within his website and to combine it with other content.
    2. The user has no claim against the provider for deletion or correction of contributions created by him.
  • § 7 End of membership

    1. This agreement is concluded for an indefinite period of time.
    2. If there is an important reason, the provider is entitled to block the user's access immediately and to terminate the membership without notice.
    3. After termination of membership, the provider is entitled to block the user's access. The provider is entitled, but not obliged, to delete the content created by the user in the event of termination of membership. A claim of the user to the surrender of the created contents is excluded.
  • § 8 Legal choice

    The contractual relations between the provider and the user shall be governed by the laws of the Federal Republic of Germany. The mandatory consumer protection regulations of the country in which the user has his habitual residence are excluded from this choice of law.
